Frequently Asked Questions
The federal estate tax exemption for 2024 is $13.61 million per individual. In 2025, it increases to $13.99 million. This amount is adjusted annually for inflation. Married couples can combine their exemptions through portability, potentially sheltering up to $27.22 million from federal estate taxes in 2024.
Currently, 17 states plus the District of Columbia impose estate taxes: Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Minnesota, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, and District of Columbia. Each state has its own exemption amounts and tax rates, which are typically lower than federal exemptions.
Portability allows a surviving spouse to use any unused portion of their deceased spouse's federal estate tax exemption. To elect portability, the executor must file IRS Form 706 within 9 months of the date of death (plus a 6-month extension if requested). This election can effectively double the amount a married couple can pass tax-free to their heirs.
Life insurance proceeds are generally income tax-free to beneficiaries. However, they are included in your taxable estate if you own the policy at death. Using an irrevocable life insurance trust (ILIT) can remove the proceeds from your taxable estate. The calculator includes life insurance in the estate value unless specifically excluded through proper estate planning.
